Pursuant to the PENNSYLVANIA CLEAN STREAMS LAW, the PENNSYLVANIA DEPARTMENT OF ENVIRONMENTAL PROTECTION Rules and Regulations, the SURFACE MINING CONSERVATION and RECLAMATION ACT, and the BITUMINOUS MINE SUBSIDENCE and LAND CONSERVATION ACT as amended, notice is hereby given that ArcelorMittal USA Pristine Resources doing business at 129 Bethlehem Rd, Revloc, PA, 15948, has made application to the Pennsylvania Department of Environmental Protection for a revision to CRDP permit #63743705 and reactivate the NPDES permit for the facility NPDES Permit No. PA0215732. The proposed revision will increase the permit area by 20.8 acres to facilitate construction of a 4-inch water pipeline on the CRDP permit area to transport impounded CRDP water for treatment. The CRDP permit area is located in Marianna Borough and West Bethlehem Township, in Washington County, PA and is known as Marianna 58 CRDA. The added 20.8 acre permit area boundary begins on Horne Valley Rd at a point 410 feet west of the intersection of Horne Valley Rd and Beeson St., then 1120 feet west along Horne Valley Rd; then departing Horne Valley Rd and continuing southwesterly 980 feet to a boundary corner; then northwesterly 380 feet to a boundary corner; then in an irregular fashion approximately 2350 feet to the northeast to a boundary corner; then south by southeast to the point of beginning, encompassing 20.8 added acres in total, to be added to the previously existing 72.9 acre permit area, to form a new expanded CRDP #63743705 permit area of 93.7 acres. The permit areas are located on the Ellsworth, PA U.S.G.S. 7.5-minute topographic map. The receiving stream is an unnamed tributary of Horn Run, which is a tributary of Tenmile Creek. A stream variance allowing activity within 100 feet of a stream has been requested so that a 50-feet wide permit boundary peninsula can extend from the added permit area and cross the unnamed tributary of Horn Run, which is a tributary of Tenmile Creek, to facilitate construction of a discharge structure to prevent erosion of the stream bank at the point of discharge. The NPDES Permit Application is for a new, temporary discharge of impounded CRDP water as described above to UNT 40804 to Horn Run at LAT/LONG 40d 01' 26.9”, -80d 06' 22.3”. A copy of the application is available for public inspection at the Washington County Conservation District, Suite 1, 50 Old Hickory Ridge Rd, Washington, PA 15301.
